1. LIMITATION OF LIABILITY (IMPORTANT)
The Customer acknowledges that Boston Storage Locker is not an insurance company. Our service fees are based on the following strict limitations of liability:
Total Valuation: The Customer agrees that the total value of any single box, bin, or unboxed item (including its contents) does not exceed $100.00.
Maximum Recovery: The Company’s liability for lost or damaged items is strictly limited to $0.60 per pound per item, up to a maximum total of $100.00 per item/box.
Packed By Owner (PBO): The Company is NOT liable for internal damage to items packed by the Customer. If the exterior packaging shows no signs of gross mishandling, any internal breakage is deemed a result of improper packing by the Customer.
Excluded Items: The Company shall have zero liability for: jewelry, cash, collectibles, fragile items (glass/mirrors), electronics (TVs/computers), or particleboard furniture (IKEA-style).
2. MANDATORY LABELING REQUIREMENTS
Proper identification is the Customer’s responsibility.
Required Info: Every individual item must be clearly labeled with the Customer’s Full Name and Order Number.
Placement: Labels must be placed on the side of the box, not the top.
Liability Exclusion: Any item received without a clear, legible label is stored at the Customer’s sole risk. The Company is not liable for the loss or delayed delivery of unlabeled items. A $15.00 Relabeling Fee will be charged for any item the Company must identify for the Customer.
3. MANDATORY PACKING GUIDE & REQUIREMENTS
Failure to follow these guidelines voids all liability coverage for the affected items:
Box Integrity: Only heavy-duty corrugated boxes or heavy-duty plastic bins are permitted. No trash bags, grocery bags, or open-top crates.
Sealing: All boxes must be sealed with heavy-duty packing tape in an "H" pattern on top and bottom.
Weight Limit: No item may exceed 50 lbs. Overweight items are subject to a $25.00 handling fee.
Refrigerators: Must be defrosted, cleaned, and completely dry 24 hours prior to pickup. Doors must be taped shut only at the time of pickup.
Fragile Items: Must be wrapped in at least 2 inches of bubble wrap or professional packing paper.
4. PROHIBITED ITEMS
The Customer warrants that they will not store:
Hazardous materials, flammables (gas/aerosols), explosives, or firearms.
Perishable food, liquids (shampoo, detergent, etc.), or plants.
Illegal drugs or stolen property.
Indemnification: If a Customer’s prohibited item (e.g., leaking liquid) damages the property of other customers or the Company, the Customer agrees to pay for all resulting damages and cleaning costs.
5. ABANDONED PROPERTY & LIEN
Pursuant to Massachusetts General Laws, the Company has a warehouseman’s lien on all stored goods.
If the Customer fails to pay for services or fails to schedule a delivery within 30 days after the start of the academic semester, the items will be legally deemed Abandoned.
The Company reserves the right to sell, donate, or dispose of abandoned property to recover unpaid balances without further notice to the Customer.
6. RELEASE OF LIABILITY (WAIVER)
The Customer hereby releases Boston Storage Locker from any liability for loss or damage caused by:
Fire, flood, or "Acts of God."
Theft or vandalism (unless due to Company’s proven gross negligence).
Mold or mildew (it is the Customer's responsibility to ensure items are dry when packed).
Mechanical or electronic failure of stored goods.
7. RIGHT TO INSPECT
The Company reserves the right to open and inspect any package if there is a suspicion of prohibited items, leaking contents, or if the structural integrity of the box is failing.
